Laws about Nudism

United States:
bullet Federal law: No federal US federal law that either allows or prohibits nudity. The courts have not ruled whether the right to engage in naturism is guaranteed by the Constitution under its freedom of expression provision. Thus, the legality of various forms of undress is currently left up to the individual states and localities to decide. Nudity is generally allowed in some areas of some national parks, unless local laws have overriding jurisdiction.

In 1981 (Schad v. Borough of Mount Ephraim, 452 U.S. 61, 65-66), the U.S. Supreme Court ruled on nudity, as it appears in movies, plays and TV. They found that: "Entertainment, as well as political and ideological speech, is protected; motion pictures, programs broadcast by radio and television, and live entertainment, such as musical and dramatic works, fall within the First Amendment guarantee ... Nor may an entertainment program be prohibited solely because it displays the nude human figure. 'Nudity alone' does not place otherwise protected material outside the mantle of the First Amendment." This might be interpreted as protecting a naturist's right to engage in a nude demonstration or public performance on a beach. But the ruling does not appear to cover simple nudism.

How do you feel about nudity between parent/child of the same gender?

Today, I was laying out on my back patio sunbathing nude. No one was home but my stepdaughter, she was 6 and sat out there with me and decided to sunbathe nude as well and I thought it was so cute and had no trouble. I mentioned it to my mom and she said if someone had seen they might have called the law because it may have looked perverted. Personally, I feel nothing about it is wrong. I don't believe nudity equals sex and anyone who does is perverted and sick.

I have showered and changed in front of my stepdaughter before. Its not like I parade myself nude around my house but I feel its perfectly alright because we are both females and nothing is being done that is wrong. I know some ultra conservatives think this is just horrible and shouldn't be done.

The Myths and Facts about Nudism

Scientists have a general idea about when humans first started wearing clothes. They draw their conclusions from genetic studies of the common body louse. The body louse feeds on humans but needs clothing to infest in order to do so. The studies show that humans first began to wear clothes some 72,000 years ago. That is give or take 42,000 years, so it is not exactly pinpointed. The human has existed in it present form, homo sapiens, for around 200,000 years, so the numbers show that most likely for more than half the existence of our species, we all were nudists. A nudist is, of course, a person who does not wear clothes.

I think nudism and sex does get mixed up sometimes. I think that in
Europe and particularly in Germany the people are more in touch with
themselves and more comfortable with nudity. I remember walking round
the Englische Garten in Munich some years ago. It was full of nudists
and naked people just enjoying themselves the same way in which clothed
people would. No one batted an eyelid and its probably how nudism was
intended to be. I cannot for the life of me imagine the same scene in
London's Hyde Park. Well I can, but it wouldn't be pretty.

The point of nudism surely is the sense of freedom and the choice to
remove clothes, go for a swim and just generally chill out. I am not
sure what all the fuss is about. I wonder sometimes why people go to
extraordinary lengths just to get naked even in mid winter when any
fool can see its best to wrap up warm.

Introduction

In 1927, an American named Maurice Parmelee published The New Gymnosophy in London (it was later published as Nudism in Modern Life in the United States). Parmelee advocated nudism (or gymnosophy) as a means for beautifying the population, saying,

... Through sexual selection gymnosophy will eventually produce a much more beautiful mankind. Gymnosophists have every incentive to avoid deformations of the body, and to strive by means of a healthy and natural life for a well developed form, because deformities and malformations are all too apparent in a state of nudity. He preached the benefits of nudism--for the mind and the body--and he altered the image of nudists from sex-crazed social lepers to open-minded naturists.

It was on bucolic, grassy, eucalyptus-scented grounds in woodsy Topanga Canyon that Ed Lange created the nudist paradise of Elysium Fields--the first nudist resort to adopt a "clothing-optional" policy rather than requiring all visitors to disrobe. It still exists, 30 years after he founded it.

Gymnophobia what is it?

Gymnophobia (Greek: “Gymnos” meaning nude and “Phobia” meaning fear) is the fear of being, or seeing others, naked. A gymnophobe is someone who would like to prevent others from not wearing clothes, and who finds being a naturist or a nudist to be unnatural, offensive, or obscene. Gymnophobia is a condition that manifests itself in the form of loud protests from lawmakers and from the television soapboxes of cable news. These people consider nudism and naturism to be completely outside the norm, even an abomination, and in their frenzy to link nudity solely with sexual nudity, they seem to garner public support for their cause.

Kiata Country Club is a nudist club and not a clothing optional resort. All members and guests are expected to be nude when health and weather conditions permit. This means for example, that if you are cold or getting sunburnt you should put on some clothes. Note that except for sun protection for children, nudity is compulsory when swimming in the dam.

  Patrick Barkham seemed unaware that the main reason younger people are not becoming naturists is the inability of modern naturism to engage with the issue of sexuality (A Stitch in Time, May 31). While it is true that "naturism became popular in Germany...as a healthy outdoor lifestyle", this lifestyle also included a recognition that, socially, nudity could sometimes be erotic. It was only when naturism arrived in a more sexually conservative Britain that sexual feelings were censored out to make naturism culturally acceptable. Locating naturist clubs in isolated locations, closing their doors to younger single males, condoning activities that limited views of genitals, and creating strict rules and regulations - all these indicated that sexual feelings had become feared and denied.Ignoring this historical and cultural context can lead to a simplified view that fails to challenge the well-rehearsed comments which naturists often use in their defence, such as those quoted in Barkham's article: "naturism is not the least bit sexy"; "it's not an orgy"; "there is no sexual tension at all".

Where are all the real nudists?

I see real nudists. They walk around like everybody else. You don't even know they're naked on the weekends.

Seriously, though - a "real nudist" is anyone who decides to call him/herself a nudist, and in the most general terms possible simply refers to someone who is comfortable with the idea of being nude in mixed company. Not all of them *can* be (there are a lot of closet nudists out there). Additionally, not everyone who is comfortable with mixed nudity calls him/herself a nudist (There's a Naked News segment where the interviewer is on a nude beach, talking to various people there, asking them about nudism and I remember very clearly a stark naked woman saying "oh, I'm not a nudist." Case in point...)

Since the beginning of man, we have been naked and also intrigued by the human body and the different representations it may have. Many argue that the true origin of social nudism came from Adam and Eve. Although only two people participated, then covering up in shame wouldn't put it in either in the "social" or "nudist" categories. The true foundations of nude recreation and social nudism started in Ancient Egypt under Pharaoh Akhen-Aton (1385 - 1353 B.C.). It was during these times that students in Greece exercised and received their education in the nude. Also, most athletes played in the nude including the early Olympic Games in Greece.

A Brief Overview of The Renewal of Social Nudity in Modern European and American Cultures

Before the Judeo-Christian-Moslem concept of body shame, most of the tropical and temperate world was one big nudist camp.  Greeks and Romans wore clothing when necessary or for certain social functions, but bathing and sports were openly enjoyed while naked. As exhibited by their sculpture and ceramics, the Greeks revered youth and physical fitness.  To them the body was truly a work of divinity to be admired in its entirety.  The Olympics were an offering of the best young athletes, unencumbered by restrictive and concealing clothes.  Gymnos, or naked, was how the athlete trained and competed.   But, all things must pass.  With the crumbling of the ancient civilizations and the emergence of a new religion which stressed the sinfulness of sensuality, Europe entered the dark ages of body shame.

How come Pure Nudism website isn’t considered child pornography and illegal?

Have you ever heard of the website called Pure Nudism? I am not sure who operates it. It seems to be featuring nudists from Russia and Eastern Europe that engage in nudity around the Black Sea. The website is in English and seems to be operated by a well financed group of English speaking individuals, possibly Americans. The models appear to be Russian or Eastern European. The website claims to support nudity but in the guise of supporting family nudity seems to feature nude children.

Why Nudism?

Feeling totally free. The feeling of the air, sun, breeze on your body. Nowhere else can you feel totally free, without the constraints of clothing. Imagine swimming in the pool without that uncomfortable bathing suit, then getting out of the pool without that wet, soggy suit clinging to your skin. Then lying in the sun and getting a tan without those unsightly tan lines. As you walk around, your dried off naturally by the sun and breezes, what a wonderful feeling.

What is Nudism all about?

NUDISM is about being a naturist which is the same thing as a nudist. As is a nudist is a naturist. They are interchangeable terms. One part of the world prefers naturist, another part uses nudist. The bottom line is that either term refers to a person who prefers to recreate, work, relax, play games, swim, hike, visit with friends, or whatever without clothes. It creates a great feeling of comfort, relaxation, and freedom that simply cannot be achieved with the mental and physical encumbrances of clothing. Nudists will agree on this point, but will also point out that the acceptance of this truth can only be realized through participation, not through reading or thinking about it, or discussing it with others. It is an experiential reality.

The Orchard Sun Club was established in 1974. Naturist clubs had exissted in Dunedin for a long number of years before the OSC was formed by members of an existing club who wished to own their grounds. These members found grounds in Green Island, a suburb of Dunedin, and spent many months establishing games courts, swimming pool, etc. Unfortunately, a major landslide wiped out all this work, and the members had to begin again. Through their efforts, much of what had been before was re-established only to have vandals destroy buildings and facilities. The Auckland Sun Club had it's beginings early in the 1930's and it's continuing existence is a great tribute to the few very courageous people who in those days were prepared to stand up for the freedom to practice social nudism. Amongst these early pioneers were Percy Cousins, Ivan Mowlam, Eric Flint and Bert Brittain.

In Auckland, Bert Brittain had made contact with a number of interested folk and by the summer of 1936/37 was in a position to found the original Auckland Sun Club.

Years later he wrote of the lengths to which he had to go in order to set up such a club against all the conventions of the time. There were clandestine meetings at the railway station in Auckland with people who identified themselves by means of a rolled up newspaper under their arms! One meeting was with a couple whom identified themselves by wearing white flowers on their coats. He told of a man and wife who had earlier tried to start a sun club. This time the media got hold of the story and reporters camped on their doorstep and just wouldn't go away. Eventually the unfortunate couple had to move from their flat and yet another attempt to form a club bit the dust. But eventually Bert's persistence paid off and the inaugural meeting of his new club was held at Woodlands Park Estate, Huia Road, Titirangi. Bert Brittain was elected as the club's first President.
